Certain amendments have also been made to support ongoing compliance with applicable laws, including <strong>Australian Consumer Law<\/strong> and the <strong>Corporations Regulations 2001 (Cth)<\/strong>.<\/p>\n\n\n\n<p><strong>Why We Are Making These Changes<\/strong><\/p>\n\n\n\n<p>We regularly review our legal and disclosure documents to ensure they remain clear, accurate, and aligned with our products, services, operational practices, and regulatory obligations.<\/p>\n\n\n\n<p>These updates are designed to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Improve the clarity focus on four key areas:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Account and client arrangements<\/li>\n\n\n\n<li>Trading and platform operations<\/li>\n\n\n\n<li>Client money arrangements<\/li>\n\n\n\n<li>Fees, risk and client protections<\/li>\n<\/ul>\n\n\n\n<p>Key updates include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Clarification of provisions relating to <strong>Wholesale Clients<\/strong>, including updates to the application of <strong>Negative Balance Protection<\/strong>, to provide greater transparency regarding the arrangements applicable to different client classifications.<\/li>\n\n\n\n<li>Clarification of certain provisions relating to <strong>Swap-Free Accounts<\/strong>, including updates to the Swap-Free Account <strong>Terms and Conditions<\/strong> to provide greater clarity regarding the operation and features of these accounts.<\/li>\n\n\n\n<li>Refinement of <strong>Joint Account<\/strong> provisions, including updated definitions and operational arrangements, to better reflect how jointly held accounts operate in practice.<\/li>\n\n\n\n<li>Updates to provisions relating to <strong>trading operations and platform availability<\/strong>, including scheduled maintenance and other circumstances that may affect access to trading services, providing greater transparency regarding the operation of our electronic trading systems.<\/li>\n\n\n\n<li>Clarification of how orders exceeding <strong>Normal Market Size<\/strong> may be handled, helping clients better understand circumstances in which such orders may be accepted, managed, or declined.<\/li>\n\n\n\n<li>Updates to provisions relating to <strong>prohibited conduct<\/strong>, aligning terminology with current regulatory expectations and providing clearer guidance regarding trading behaviours that may not be permitted.<\/li>\n\n\n\n<li>Clarification of <strong>client money arrangements<\/strong>, including the operation of Cash Management Trust Accounts (CMTAs), term deposit arrangements, and the treatment of interest associated with those arrangements, providing greater transparency regarding how client funds are managed.<\/li>\n\n\n\n<li>Inclusion of <strong>inactivity fee provisions,<\/strong> to align the disclosure of fees and charges with the Product Disclosure Statement (PDS) and improve transparency regarding account-related fees that may apply when an account remains inactive for an extended period.<\/li>\n\n\n\n<li>Updates to provisions relating to <strong>manifest errors<\/strong>, <strong>force majeure events<\/strong>, <strong>defaults<\/strong>, and <strong>account termination<\/strong>, improving clarity regarding how exceptional circumstances may be addressed and how they may affect clients.<\/li>\n\n\n\n<li>General refinements throughout the document to improve readability, reduce ambiguity, and ensure greater consistency between the Account Terms and Product Disclosure Statement.<\/li>\n<\/ul>\n\n\n\n<p><strong>Product Disclosure Statement (PDS)<\/strong><\/p>\n\n\n\n<p>The Product Disclosure Statement has been updated to reflect enhancements to our product offering and to provide additional information regarding ETF CFDs and associated costs.<\/p>\n\n\n\n<p>Key updates include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The addition of <strong>Exchange Traded Funds (ETFs)<\/strong> as an underlying asset for <strong>Contracts for Difference (CFDs)<\/strong>, expanding the range of products covered by the PDS.<\/li>\n\n\n\n<li>The inclusion of <strong>illustrative ETF CFD examples<\/strong> to assist clients in understanding how ETF CFDs operate and how pricing, exposure, and trading outcomes may be determined.<\/li>\n\n\n\n<li>Clarification of <strong>fees, charges and adjustments<\/strong> applicable to ETF CFDs, including dividend and distribution adjustments and transaction-related costs, providing greater transparency regarding the costs associated with trading these products.<\/li>\n\n\n\n<li>General refinements to product disclosures, risk disclosures, and explanatory content to enhance clarity and support informed decision-making by clients.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong>What This Means for Clients<\/strong><\/p>\n\n\n\n<p>For most clients, these updates do not require any action and do not change the way they access or use their trading account.<\/p>\n\n\n\n<p>The updates primarily clarify existing arrangements, improve consistency across our legal documentation, and provide additional information regarding ETF CFDs, associated fees, and account-related processes.
