Important Update: Account Terms and Product Disclosure Statement (PDS)
We wish to inform our clients and stakeholders that our Account Terms and Product Disclosure Statement (PDS) have been updated which will become effective on and from 25th September 2026.
As part of our regular review process, these documents have been updated to improve clarity, enhance consistency across our disclosures, and support ongoing compliance with applicable regulatory requirements. Certain amendments have also been made to support ongoing compliance with applicable laws, including Australian Consumer Law and the Corporations Regulations 2001 (Cth).
Why We Are Making These Changes
We regularly review our legal and disclosure documents to ensure they remain clear, accurate, and aligned with our products, services, operational practices, and regulatory obligations.
These updates are designed to:
- Improve the clarity and readability of our documentation.
- Enhance consistency across our legal and disclosure documents.
- Provide clients with additional information about certain products and account arrangements.
- Reflect current operational and administrative practices.
- Support informed decision-making by clients.
Summary of Changes
Account Terms
The changes to the Account Terms focus on four key areas:
- Account and client arrangements
- Trading and platform operations
- Client money arrangements
- Fees, risk and client protections
Key updates include:
- Clarification of provisions relating to Wholesale Clients, including updates to the application of Negative Balance Protection, to provide greater transparency regarding the arrangements applicable to different client classifications.
- Clarification of certain provisions relating to Swap-Free Accounts, including updates to the Swap-Free Account Terms and Conditions to provide greater clarity regarding the operation and features of these accounts.
- Refinement of Joint Account provisions, including updated definitions and operational arrangements, to better reflect how jointly held accounts operate in practice.
- Updates to provisions relating to trading operations and platform availability, including scheduled maintenance and other circumstances that may affect access to trading services, providing greater transparency regarding the operation of our electronic trading systems.
- Clarification of how orders exceeding Normal Market Size may be handled, helping clients better understand circumstances in which such orders may be accepted, managed, or declined.
- Updates to provisions relating to prohibited conduct, aligning terminology with current regulatory expectations and providing clearer guidance regarding trading behaviours that may not be permitted.
- Clarification of client money arrangements, including the operation of Cash Management Trust Accounts (CMTAs), term deposit arrangements, and the treatment of interest associated with those arrangements, providing greater transparency regarding how client funds are managed.
- Inclusion of inactivity fee provisions, to align the disclosure of fees and charges with the Product Disclosure Statement (PDS) and improve transparency regarding account-related fees that may apply when an account remains inactive for an extended period.
- Updates to provisions relating to manifest errors, force majeure events, defaults, and account termination, improving clarity regarding how exceptional circumstances may be addressed and how they may affect clients.
- General refinements throughout the document to improve readability, reduce ambiguity, and ensure greater consistency between the Account Terms and Product Disclosure Statement.
Product Disclosure Statement (PDS)
The Product Disclosure Statement has been updated to reflect enhancements to our product offering and to provide additional information regarding ETF CFDs and associated costs.
Key updates include:
- The addition of Exchange Traded Funds (ETFs) as an underlying asset for Contracts for Difference (CFDs), expanding the range of products covered by the PDS.
- The inclusion of illustrative ETF CFD examples to assist clients in understanding how ETF CFDs operate and how pricing, exposure, and trading outcomes may be determined.
- Clarification of fees, charges and adjustments applicable to ETF CFDs, including dividend and distribution adjustments and transaction-related costs, providing greater transparency regarding the costs associated with trading these products.
- General refinements to product disclosures, risk disclosures, and explanatory content to enhance clarity and support informed decision-making by clients.
What This Means for Clients
For most clients, these updates do not require any action and do not change the way they access or use their trading account.
The updates primarily clarify existing arrangements, improve consistency across our legal documentation, and provide additional information regarding ETF CFDs, associated fees, and account-related processes. They are intended to help clients better understand our products, services, and account arrangements.
